NERA Economic Consulting is delighted to support Paris Arbitration Week 2022 (PAW), which will take place virtually between 28 March and 1 April. In its sixth edition, PAW aims to bring together the international arbitration community for a week of professional and academic debates. Last year, PAW had over 35 official events and 6,300 global participants. NERA will once again host two webinars as part of PAW’s robust programming.

In our first webinar, “Estimating Damages in the Face of Uncertainty,” we examined, from both legal and economic perspectives, complex issues that often arise when the quantification of damages is uncertain.

On 29 March at 15.30 CET, NERA Director Fernando Jiménez Latorre moderated a panel of experts, including NERA Associate Director Dr. Alexandre Carbonnel, Gide Loyrette Nouel Partner Alexandra Munoz, Quinn Emanuel Urquhart & Sullivan LLP Managing Partner Thomas Voisin, and Clyde & Co Counsel Michael Conrad, who shared their experience and insights regarding the challenges caused by uncertainty when estimating damages.

The panel addressed:

  • How to approach uncertainty in the estimation of damages from a legal perspective;
  • How to measure uncertainty when assessing damages and evaluate the robustness of estimates;
  • Relevant procedural issues; and 
  • Potential solutions for addressing disagreements between experts.
