The Competition Appeal Tribunal dismissed a £1.3 billion class action claim against BT in the first competition collective action to go to trial in the UK. The claim was brought by Mr. Justin Le Patourel as the class representative for a class of BT customers.

Managing Director David Matthew, instructed as one of BT’s economic experts by Simmons & Simmons LLP and supported by Director Adrien Cervera-Jackson, Consultant James Thomas, and Analyst Tanya Narang, provided expert economic evidence at trial on the economics of excessive pricing, the differences between price intervention under ex post competition law and ex ante regulation, the appropriate cost standards to use, and how these matters meet the United Brands excessive pricing tests.
